Administrative Dispute Within Merrikh Sport Club

Sudan Al Youm website on 16 June 2018 ,reported a dispute between two Boards of Directors of Sudan’s Merrikh Sport Club. While members of one Board of Directors are elected, members of another Board are nominated. The website said the dispute escalated after an elected member of the Board, Mr. Khalid Ahmed Al Mustafa, had tendered his resignation. The website added: “the crisis worsened after the Minister of Sports of Khartoum State, Mr. Al Yasa Al Siddiq, nominated a new Board of Directors although he promised to nominate an interim Board. The administrative court’s dismissal of an appeal filed by the members of the elected Board against the Minister’s decision to nominate an interim Board was also one of the reasons for escalation of the crisis. Chairman of the Sudanese Foodball Association, Kamal Shaddad, said they would deal with the legitimate Board (the elected one) adding that the dispute would be referred to the Association’s Legal Committee for consideration. In another report published on the website of Al Sahafa newspaper of 16 June 2018, the court dismissed the appeal filed by the elected Board against the Minister of Youths and Sports of Khartoum State on the basis of an argument that there was no objected against party after the Minister set up a steering committee and then dissolved it and formed another one. The elected Board rejected the non-hand over of the executive committee and all other facilities and/or resources to the nominated committee and threatened to refer the case to FIFA.

Nomination is a violation of the right to assembly and association referred to in Article 40 (1) of Sudan’s constitution and also represents a violation of the right to association set out in Article (21) of the International Covenant on Civil and Political Rights.
